Why it pays for your clients to have legal expenses insurance

It all started when Mrs Green erected a fence to mark what she believed to be the boundary line between the two properties. Initially, the neighbour’s request to have the fence removed was denied by the Judge.

However, this decision was repealed and brought to the Court of Appeal who found in favour of the neighbours, ruling that the fence that Mrs Green had erected ‘trespassed’ onto her neighbours’ land by just over a foot. The result of this meant that Mrs Green was faced with a legal bill of £50,000!

In short, Legal Expenses Insurance (LEI) could have saved Mrs Green from having to fork thousands as LEI typically covers the policyholder against the potential costs of legal disputes either brought by or against the policyholder.

The above case serves as a warning to privately funded litigants and is a good reminder that sometimes it pays to be covered, even if your clients believe that they will never need to make a claim on the policy. Better to be safe than sorry as they say.

The benefit of having LEI in place is that as long as the claims is accepted, your clients are not left having to solely foot a hefty legal bill.
